Abstract

Sayed Mohammad Hashemi Professor, Faculty of Law Shahid Beheshti  Under Art. 99 of Constitional Law, The supervision on election is construed a duty of the Guardian Council (Shoraye Negahban). In order to prevent the influence of executors and to guarantee a safe election, it is obvious that there should be some sort of supervision. The first condition to reach this aim is that the members of the Guardian council should not have an effective relationship to political factions and groups, and the rule of prohibition of membership in the Council with the other executive duties must be observed. In this article, by investigating the “expedient supervision” and “supervision for taking in formation” while considering the quality of the supervision, it is concluded that the superintendence of the Guardian Council is disciplinary so that the Council as an impartial observatory by comparing the volunteers’ identification with the legal conditions and by supervising the course of election could guarantee a legal and free election.

Abstract

The oath has long been manifested in culture and literature in a variety of ways. In this study, the patterns of swearing in Bakhtiari people is analyzed. Oaths of fire, fire stoves, blades of sun, running water, bread, nuns, temples, devotees, underworlds, and thugs are the most important examples of swearing among the people of Bakhtiari. The importance of taking an oath to this people is the last way to prove the truth of the word and to distinguish the righteous from the wrongdoer. In this study, while studying the types of oaths in Bakhtiari people, the literary characters and their mythological aspects are investigated as well. This research is fundamentally based on the field-based library study and qualitative content analysis. After examining various sources and analyzing the literary and mythological aspects of swearing among the Bakhtiari people, it can be said that the ritual is a remnant of the same ritual in ancient Iran. Also, the oaths of fire, bread and salt, time, running water, sun and souls of the beloved ones are among the most important and common manifestations of oath taking among these people that have many literary and mythological aspects. The function of oath is to prove the truth of the word and recognize the true from false.

Abstract

In this paper, attempts have tried to study Fairclough’s theory of “inequality of power in the dialogue" by analyzing the dialogues between identical and opposing characters in the novel Fire without smoke by Nader Ebrahimi to identify powerful or passive characters, and decode the novel from the ideological perspective of the author.
To more regulate, this theoretical framework, the questions raised in the Shorter’s model (1996), were used to analyze power relations in the dialogues of characters with the aim of determining the type of relationship and the dominance of the personality poles of the story: Galan - the hero that relies on his physical strength - and Alani - the hero who relies on the power of thought and mind.
The analysis of data suggested that the way the two main characters of the novel interacted with others in their discourse was directly related to the up and downs of their lives. Galan's interaction was limited to an esoteric group of people around them, and as this circle of friends was limited down, his power diminished too, so that with his death, the coercive hegemony and compulsory domination associated with his behavior came to end.
In contrast, Alani not only struck a conversation with people from all aspects of life, especially women and the lower classes of the community, but also urged them to play a key role in the dialogue with the people around them. This contributed to the recognition of his intellectual and political authority and conduct, and even after his death, his thoughts continued to touch the speech and practice of the next generations.

Abstract

In this research, five entrepreneurship characteristics consisted of achievement need, independent need; risk taking, creativity and determination, for the assess went of entrepreneurship profile of mazandaran university's students were measured. According to the results of the survey, of the 1843 students of this university, about 21 percent have entrepreneurship characteristics. Total mean score of the students with entrepreneurship characteristics was equal to 39.67, but the total mean score of un-entrepreneur students group was 29.89.In general, total mean score of the students was 31.92.There was a significant difference between this and the minimum of the acceptable mean (=37). On the other hand, determination trait (with the mean of 7.8) in comparison with other characteristics was more observed among the students of this university. The scores of achievement need, independent need, risk taking and creativity of students were a little different with the minimum of the acceptable mean of these characteristics.

Abstract

The paper deals with the topic of visually based L2 acquisition in higher education and evaluates the impact of the use of visual images based on Kolb´s theory of experiential learning. It evaluates its impact on the students´ risk-taking, motivation and anxiety. The research was conducted at the English Department of the University of Diyala, Iraq. The total number of participants was forty (n = 40) and they all were first-year students at English Department. The research was conducted by using guided interviews through the Google Meet platform. The main idea of the research was to evaluate how much will experiential learning, via the reading pictures technique, influence college students’ risk-taking, motivation, and anxiety. The research results show that students’ motivation and risk-taking were affected positively by using pictures. It further shows that the classroom anxiety of the students was less affected than the other two variables

Abstract

The present article deals with the issues of nationalization and expropriation in the light of Iran-United States Claims Tribunal Awards by looking at their legality and the limits on the rights of states to nationalise and expropriate, while discussing some case law. I will argue that the state’s right to nationalize foreign property is an attribute of its sovereignty and derives from territorial supremacy of the state. It is also proposed to examine the questions of State responsibility for the injurious consequences of certain wrongful acts or omissions during the Revolution of 1979. The question is whether the events of the revolution and the appointment of temporary managers to administer the foreign companies’ affairs could be interpreted as constituting an expropriation and whether this measure is in full accord with international jurisprudence. The Tribunal’s decisions make it clear that regardless of whether the state has obtained any value of property or not, responsibility exists whenever acts attributable to a state have deprived a foreigner of his property rights.
